Hereinafter referred to as Herdade do Estacal or HE.

2. Purpose

These Terms of Service govern access to and use of the Herdade do Estacal online store, as well as the conditions applicable to the purchase and sale of products available on the platform.

By using the website or making a purchase, the user confirms that they have read, understood and fully accepted these Terms.

3. Products and Availability

Herdade do Estacal selects products from the Alentejo, guaranteeing the origin, quality and authenticity of every item.

All product descriptions, images and information are presented as accurately as possible. However, slight variations may occur due to the artisanal or agricultural nature of the products.

Product availability is limited to existing stock. If a product becomes unavailable after payment, the customer will be contacted to arrange a full or partial refund or, by agreement, the replacement of the product.

4. Prices and Payments

The prices shown include VAT at the applicable statutory rate and are expressed in euros (€). Shipping costs are displayed during checkout in accordance with the applicable Shipping Policy.

Available payment methods include credit or debit card (Visa, Mastercard, etc.), MB Way, Multibanco reference and any other options displayed when completing the purchase.

Herdade do Estacal reserves the right to change prices, promotions or commercial conditions without prior notice. However, the prices and conditions in effect when the order is confirmed will apply.

5. Purchase Process

The customer selects the products and adds them to the shopping cart. The customer confirms the billing details and delivery address and selects the shipping method. The purchase is completed through secure payment. The customer then receives an email confirmation containing the order summary.

The contract is considered concluded when Herdade do Estacal confirms receipt of payment.

6. Shipping and Delivery

Deliveries are made to Mainland Portugal, the Autonomous Regions of the Azores and Madeira, and selected European destinations, under the terms and conditions set out in the applicable Shipping Policy.

Orders are dispatched through NACEX, DHL and CTT (or equivalent logistics partners), with tracking and delivery directly to the recipient, in accordance with the Herdade do Estacal Shipping Policy.

Average delivery times after dispatch:
Mainland Portugal: normally by the end of the following business day (delivery expected by 7:00 p.m., subject to operational exceptions).
Azores and Madeira: typically 5 to 10 business days.
Europe: delivery times vary by zone and destination and are specified in the Shipping Policy as estimated transit times for each zone.

These delivery times are estimates and may vary during periods of higher order volume, such as Christmas, Easter, public holidays and promotional campaigns, or for reasons attributable to the carrier.

Perishable products are packed with particular care to preserve their integrity and freshness until delivery, in accordance with the conditions described in the Shipping Policy. For quality and safety reasons, perishable products are preferably shipped from Monday to Thursday.

7. Right of Withdrawal

Under Portuguese Decree-Law No. 24/2014, consumers have 14 days to exercise their right to withdraw from the contract without having to provide a reason.

The right of withdrawal does not apply to perishable food products or products with a limited shelf life, or to sealed products that cannot be returned for hygiene or health-protection reasons and which have been opened after delivery.

To exercise the right of withdrawal, the customer must communicate their decision by email to shop@herdadedoestacal.pt, providing the order number and the information required to identify the purchase.

8. Returns and Refunds

Returns must be authorised in advance by Herdade do Estacal.

Products must be returned in perfect condition, in their original packaging and with all components and accessories, except where there is a manufacturing defect or lack of conformity.

After the returned products have been received and their condition verified, the refund will be processed using the original payment method within a maximum of 14 days, in accordance with applicable legislation.

9. Warranties

Non-food products benefit from a two-year statutory warranty under Portuguese Decree-Law No. 84/2021.

For food and natural products, Herdade do Estacal guarantees conformity and food safety until the expiry date stated on each item, provided that the recommended storage conditions are followed.

10. Complaints and Dispute Resolution

Customers may submit a complaint by email to shop@herdadedoestacal.pt or through the Portuguese Electronic Complaints Book at www.livroreclamacoes.pt.

11. Intellectual Property

All website content, including text, images, logos, trademarks, design and code, is owned by Herdade do Estacal or by duly authorised partners.

Its reproduction, distribution, transmission or use for commercial purposes is prohibited without the prior written consent of Herdade do Estacal.

12. Data Protection

Herdade do Estacal undertakes to process customers’ personal data in accordance with Regulation (EU) 2016/679 (GDPR) and its Privacy Policy, available on the website.

Use of this website implies full acceptance of the Herdade do Estacal Privacy Policy and Cookie Policy.

13. Changes to the Terms

Herdade do Estacal may update these Terms of Service at any time. Changes take effect immediately upon publication on the website, and users are advised to review this document periodically.

14. Governing Law and Jurisdiction

These Terms are governed by Portuguese law.

Any dispute arising from the interpretation or performance of these Terms shall be subject to the jurisdiction of the courts of the judicial district of Beja, with express waiver of any other jurisdiction.
